Welcome to McKay Provisions (“we”, “us”, “our”). We operate the website and online store at www.mckayprovisions.com (the “Services”). These Terms of Service (“Terms”) govern your access to and use of the Services, including browsing, purchasing, and interacting with McKay Provisions.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products to you.

 

 

1. ELIGIBILITY & ACCOUNT RESPONSIBILITY

You must be of legal age in your jurisdiction to use the Services. If you create an account, you are responsible for maintaining the confidentiality of your login and for all activity under your account.

 

 

2. OUR PRODUCTS

All McKay Provisions goods are made to order, handcrafted one-at-a-time using premium full-grain leather. Natural leather carries variations such as grain patterns, color tone shifts, healed scars, marks from ranch life, and patina development. These are not defects — they are the signature of real leather and part of the character of each piece.

Product images are representative and may vary slightly from your item due to natural material variation, handcrafting, lighting conditions, and screen settings.

We reserve the right to modify or discontinue any product without notice.

 

 

3. ORDERS

Placing an order constitutes an offer to purchase. We may accept or decline an order at our discretion. Your order is confirmed when payment has processed and an order confirmation email is issued.

Because products are made to order, we may not be able to modify or cancel an order once production has begun.

Returns, exchanges, or adjustments are handled in accordance with our Refund Policy:

Purchases are for personal use only and not for commercial resale.

 

 

4. PRICING & PAYMENT

Prices may change at any time. Posted prices do not include shipping, taxes, or duties. By making a purchase, you authorize us (and Shopify’s payment processors) to charge your selected payment method.

You agree to provide accurate billing and shipping information and to keep it updated.

 

 

5. SHIPPING & DELIVERY

Shipping time frames are estimates only. We are not responsible for delays caused by carriers, customs, or events outside our control.

Risk of loss transfers to you when the package is given to the carrier.

We will assist with carrier claims where possible, but carrier rules apply.

 

 

6. INTELLECTUAL PROPERTY

All content on the Services—including product designs, text, images, branding, logos, and layout—is owned by McKay Provisions or licensed to us. You may not copy, reproduce, or use our content without written permission.

 

 

7. THIRD-PARTY TOOLS & LINKS

We may provide access to third-party tools or link to external websites. We do not monitor or control these resources and are not responsible for their content, policies, or performance.

Use of third-party resources is at your own risk.

 

 

8. RELATIONSHIP WITH SHOPIFY

The Services are hosted by Shopify. Shopify is not responsible for your purchases or interactions with McKay Provisions. You release Shopify from liability relating to your transactions with us.

 


9. FEEDBACK & CUSTOMER CONTENT

If you submit reviews, photos, or testimonials, you grant McKay Provisions a non-exclusive license to use that content for marketing, promotional, or operational purposes.

 


10. WARRANTY

We stand behind the goods we make. Our Lifetime Warranty (“Guaranteed You’ll Die First”) covers functional craftsmanship issues such as stitching or hardware failure under normal use.

The warranty does not cover:

  • Natural patina or color change

  • Marks, scratches, or character traits inherent to full-grain leather

  • Damage due to misuse, exposure, or improper conditioning products

 

Repairs or replacements are performed at our sole discretion.

 

 

11. ERRORS & ACCURACY

We reserve the right to correct errors or update information at any time, including after an order is placed.

 

 

12. PROHIBITED USES

You may not use the Services to:

  • Violate laws or intellectual property rights

  • Harass or defraud others

  • Upload malicious code

  • Scrape, mine, or harvest data

  • Interfere with security or platform performance

Violation may result in terminated access.

 

 

13. DISCLAIMER OF WARRANTIES

Except where prohibited by law, the Services and all products are provided “as is” without warranties of any kind, express or implied.

 

 

14. LIMITATION OF LIABILITY

To the fullest extent permitted by law, McKay Provisions is not liable for indirect or consequential damages arising from your use of the Services or products.

 

 

15. INDEMNIFICATN

You agree to indemnify and hold McKay Provisions harmless from claims arising out of your misuse of the Services or violation of these Terms.

These Terms are governed by the laws of the State of California.
